Seizure
If legal proceedings are not yet underway or the judge has not yet issued a ruling, the plaintiff may seize the assets of the debtor. This is known as pre-judgement seizure.The executory seizure under a writ of attachment may be the result of the plaintiff obtaining a judgment in his/favour. If the convicted party does not fulfil the requirements of this judgement, the plaintiff may call in a bailiff in order to seize the assets.

You must submit original documents or the copy must be compared with another copy by the bailiff upon submission.

The patent number must be clearly stated.
Registration of pre-judgment seizure or seizure under warrant of execution in the register costs 27 euro per patent number. This deed is registered once all requirements have been fulfilled and the costs associated with the registration have been transferred to the bank account of NL Patent Office.
Removal of seizure
Only the party who requested the pre-judgment seizure is entitled to cease it.

The party who requested the seizure must submit a letter that clearly states that the seizure has been ceased. The letter must be signed by this party.

The related patent right number must be clearly stated.
There is no charge for registration.

Any amendment that is registered by means of a deed is entered in the patent register with retroactive effect.
